General
1. This website can be accessed at www.kocobeauty.co.za (“the Website”) which is owned and operated by Claire Knepscheld T/A Koco , “Koco Beauty”, “us”, “our” and “we”).
2. The Website facilitates the ordering, selling and delivery of a range of Beauty Products.
3. These Terms and Conditions set out the policies for the governance of the sale, delivery and ordering of Products and the use of the Website.
4. By accessing the Website, you acknowledge that you have read, understand and agree to the terms and conditions set out herein.
5. Any links or referrals to text elsewhere on the Website contained in these Terms and Conditions shall be deemed to form part of these Terms and Conditions.
6. We reserve the right to amend these Terms and Conditions or any parts thereof at any time and without notice.
7. No clause or subclause contained in these Terms and Conditions is intended or should be understood to unlawfully restrict, limit or avoid and rights or obligations appliable to House of Mode or to yourself.
8. Use of the Website is subject to these Terms and Conditions. Should you not accept these Terms and Conditions we request that you refrain from using the Website.
9. These Terms and Conditions constitute the entire Terms and Conditions, and no variation, addition, deletion, or cancellation will be of any force or effect unless it is reduced to writing and signed by both parties or their duly authorised representative.
10. If any paragraph or term is void, unenforceable, or illegal said paragraph or term may be severed from this agreement and the remaining terms and paragraphs will still remain in full force and effect.
11. These Terms and Conditions are governed by and interpreted in accordance with the law of the Republic of South Africa.
12. Should any dispute arise between you and Koco Beauty you consent to the jurisdiction of the High Court of the Republic of South Africa, Durban , Kwa-Zulu Natal
2. Returns Policy
2.1.Koco Beauty is committed to providing quality Product .Should you be dissatisfied with your Product you can return them to us, and we will either repair/replace them or provide you with a voucher for the Website, subject to the conditions set out below.
2.2.Unwanted Products
2.2.1.You are able to return any unwanted product to us ( Excluding UV & LED Product ) provided:
2.2.1.1.it is undamaged and unused, with all original labels still attached;
2.2.1.2.the original packaging is intact, and the Products are still contained therein;
2.2.1.3.no parts, accessories or additions are missing;
2.2.1.4. the return of unwanted Product must be logged on the Website within 5 ( Five ) days from the date of receipt thereof.
2.2.2.Return courier fees at your own expense.
2.2.3.Upon our receipt of the returned unwanted Product, we will inspect them to ensure compliance with para 2.2.1. above within 3 (three) to 5 (five) business days. Should the Product be compliant, we will provide you with a voucher for the costs of said Products within 5 (five) to 7 (seven) business days of receipt thereof.
2.3.Should we accidentally deliver the wrong Products to you, kindly notify us and we will arrange for the Products to be collected from you at no extra charge. Once we have received the Products and inspected them, we will, at your discretion, deliver the correct Products to you, provided they are still available, or provide you with a voucher for the purchase price paid.
2.4.Should you wish to exchange Products for a different Product, provided that the requested product is available and is available at the purchase price originally paid, and subject to the stipulations in para 2.2.1, exchange courier fees will be at your own expense.
2.5.Certain Products are not eligible for refund and/or exchange. These include:
2.5.1. UV & LED cured Product , unless product has fully cured 24 to 48 hours post purchase thereof.
2.6.Where any Products are damaged at the time of delivery or collection kindly notify us by sending an email to sales@kocobeauty.co.za .
We will make arrangements for the Products to be collected from you at no extra charge. Upon receipt of the Product and subject to an inspection process we will either replace the product or provide a voucher for the purchase price.
3. Payment
3.1. Every effort is taken to ensure that payment facilities are secure. All payments are processed via PayFast
3.2. These payments can be affected in the following manners:
3.2.1. debit card; should you elect to make use of a debit card to pay for your Garments you warrant that you are fully authorised to make use of said debit card. You further warrant that the account attached to said debit card has sufficient funds to cover all costs associated with the Garments;
3.2.2. credit card; should you elect to make use of a credit card to pay for your Garments you warrant that you are fully authorised to make use of said debit card. You further warrant that the account attached to said credit card has sufficient funds to cover all costs associated with the Garments; and/or
3.2.3. instant EFT.
4. Delivery of Product
4.1. All deliveries are handled by The Courier Guy.
4.2. Deliveries are arranged by Koco Beauty the cost of which will be determined based on, but not limited to, the location to which the Garments should be delivered, the remoteness of this location, accessibility to the delivery address, as well as the selected timeframe for delivery.
4.3. A quote of this delivery cost will be provided upon your ordering of the Garments in question and is payable upon demand by Koco Beauty
4.4. Kindly note that delivery addresses cannot be changed once payment has been received for the order.
4.5 Free shipping on orders over R2000
5. Conclusion of Sales and Availability of Product
5.1. An order is placed only after payment has been made for said Product
5.2. An order is only accepted by Koco Beauty once the Product have been dispatched by us.
5.3. Product placed within a basket or Wishlist do not constitute a final agreement and we cannot be held liable should the Product no longer be available, or if the price of said Product has changed.
5.4. All Product sold by Koco Beauty are subject to stock limitations and availability, and prices are subject to change at any time without notice to you. Koco Beauty takes every effort to ensure that stock availability is indicated accurately on the Website. However, should Product no longer be available subsequent to you placing an order for said Product we will notify you of this fact and refund any amounts paid for said Product. No guarantees are given for the availability of stock.
6. Privacy Policy
6.1. Kindly refer to our Privacy Policy for more information as regards your personal information. The Privacy Policy is incorporated herein by reference.
7. Vouchers
7.1. Vouchers will only be offered when you have made a valid exchange or return.
7.2. Said voucher will be for the value of the amount paid by you to House of Mode, less any delivery costs that may be applicable to affecting the return.
7.3. Vouchers will be valid for a period of 3 (three) years after the date on which the exchange was processed.
7.4. Vouchers are non-refundable for the cash equivalent and do not accrue interest.
7.5. Vouchers can be used in conjunction with another payment method as referred to in para 5 to purchase Product that are of higher value than the voucher.
7.6. Koco Beauty accepts no responsibility or liability for the unauthorised use and/or distribution of a voucher after it has been sent to the provided email address.
8. Discounted Product
8.1. Koco Beauty may, from time to time, offer discounts on select Product for a specified period of time.
8.2. Discounts include, but are not limited to, any Product which are subject to a lower-than-normal price (‘discount’ or ‘discounted’).
8.3. Only limited quantities of discounted Product will be made available at a time. Product may be available at the normal cost once the discount period has ended.
8.4. Discounted Products are unlimited per customer.
8.5. Placing a discounted Product in your cart or ordering the Product without paying for it does not reserve the Product for you. Only once payment has been received within 24-hours of placing the order, will the discounted Product, as well as the associated discount, be reserved for you.
8.6. Kindly note that discounted items are non-refundable and non-exchangeable.
9. Ownership and copyright
9.1. The contents of the Website, including but not limited to logos, icons, text, lay-outs, graphics, trade names and designs are protected by copyright and trademark law, and are the sole property of Koco Beauty.
10. Disclaimer and Limitation of Liability
10.1.The use of the Website is entirely your own risk.
10.2.Koco Beauty accepts no responsibility for any risk or loss or likewise that results from use of or reliance on the Website.
10.3.Koco Beauty makes no representations or warranties, either implied or explicit, of any kind with regards to the Website or the use thereof.
10.4.The Website is provided ‘as is’ without any warranties, either implied or explicit, of any kind.
10.5.You waive Koco Beauty of any liability, loss or damages, whether direct, indirect, special, consequential or incidental, which may arise as a result of your use or reliance upon the Website.
